General terms and conditions of sale

Article 1 - Legal status of the contract

This contract is subject to the status of residences with services. This lease is entered into as a temporary residence. The premises may not be used as a principal or even secondary residence. The resident may not use the premises for any commercial, craft or professional activity. The occupying resident may not avail himself of the legal provisions applicable to residential leases, in particular with regard to the maintenance of the premises. Consequently, the contract will be governed by the provisions of the Civil Code and by the conditions set out herein.

Article 2 - Booking

The reservation of a flat in the residence Les Balcons de la Neste will be made in writing (fax, e-mail, voucher, order form) and will only be valid after written acceptance by SAS ARREAU BALCONS DES NESTES, the operating company of the residence. Confirmation of the customer's reservation by SAS ARREAU BALCONS DES NESTES remains at the sole discretion of the latter. In addition, the reservation must, to be firm, be guaranteed by a credit card or be followed by the payment of a deposit or the total payment of the stay. The aforementioned deposit must correspond to one night for stays of less than 4 nights, and to 30% of the total cost of the stay for stays of more than 3 nights. The deposit must be paid within 7 days of booking. After this deadline, the booking will be cancelled. Group bookings, i.e. bookings for more than 5 properties booked by the same entity for the same period, are subject to special group booking conditions. Different conditions may apply for promotional rates. In this case, the special conditions mentioned under the price description on the booking page take precedence over the conditions mentioned above.

Article 3 - Terms and conditions of payment

Las facturas deberán abonarse inmediatamente, en euros, en el momento de su presentación. El día de la llegada del cliente, SAS ARREAU BALCONS DES NESTES solicitará el pago íntegro. El pago de todos los servicios opcionales se exigirá en el momento de la presentación de la factura correspondiente. En caso de impago en la fecha de salida del residente, SAS ARREAU BALCONS DES NESTES se reserva el derecho de cargar en su tarjeta de crédito el importe pendiente. Los pagos podrán efectuarse mediante tarjeta de crédito, cheque, efectivo o cheques vacaciones.

Article 4 - Prices Prices are given in euros

In order to avoid any errors or disputes due to problems with printing documents or updating online sites, the definitive prices are those that will be communicated to you at the time of booking. They are inclusive of all taxes and include only the provision of accommodation. They do not include tourist taxes or optional services. Any promotions apply to the accommodation only.

Article 5 - Security deposit

On arrival, when the keys are handed over, the tenant will pay a security deposit of 300 euros by cheque (not cashed) or by pre-authorised credit card debit. Once the keys have been returned, if no damage has been found and after payment for any ancillary services consumed on site, the security deposit will be returned immediately and in full. Failing this, the security deposit will be returned, after deduction of repairs following damage, replacement of missing objects or cleaning of the premises, no later than 60 days after the tenant's departure.

Article 6 - Changes to length of stay

The duration of the stay is that stated in the booking confirmation or in the accommodation offer. Subject to availability and at the discretion of SAS ARREAU BALCONS DES NESTES, the duration of the stay may be extended, without any obligation to remain in the same flat or at the same price, the payment for the new period being made in advance. Early departures do not give rise to any reimbursement.

Article 7 - Cancellation / No-show

All cancellations must be notified in writing to SAS ARREAU BALCONS DES NESTES. The effective date of a written cancellation will be the date on which it is received by the establishment.
If the stay is longer than 3 nights:
  • Cancellation received before the 30th day prior to arrival no cancellation fee.
  • For cancellations received between 30 and 15 days prior to arrival, a cancellation fee of 30% of the total cost of the stay will be charged.
  • In the event of cancellation between 14 and 8 days prior to arrival, compensation of 50% of the total cost of the stay.
  • In the event of cancellation between 7 and 3 days prior to arrival, compensation of 75% of the total cost of the stay.
  • In the event of cancellation between 2 days and the day of arrival, compensation of 100% of the total amount of the stay. Failure to arrive, in the absence of cancellation, will be deemed to be a 'no show' and will be subject to the penalties specified above. The credit card left as a guarantee will be debited in accordance with the above terms and conditions. In all cases SAS ARREAUBALCONS DES NESTES reserves the right to proceed with the recovery of the sums in question by all legal means of recovery.

Article 8 - Arrival and departure

Keys are handed over between 4pm and 7pm on the day of arrival. The keys must be returned to Résidence Les Balcons de la Neste at 5 Route de Lançon, 65240 ARREAU before 10am on the day of departure. It is the resident's responsibility to check the opening days and times when booking and, if necessary, to give notice of an arrival or departure outside the opening times. The residence staff will then make direct arrangements with the resident to inform them of the procedure to follow on arrival or departure to find or return the keys to their accommodation.

Article 9- Obligations of the resident

The flat will be made available to the resident in a good state of repair. The resident will use the rented premises and their facilities as a "good father of the family" and will behave in such a way as to respect the peace and quiet of the other residents. The following occupancy norms must be respected: 4 occupants for a studio cabin and a 4-seater T2, 6 for a T2 with a cabin and
cabin and 7 or 8 for a T2 double cabin. The resident undertakes to keep the personal property provided in the flat in good general condition and must report any defects or malfunctions to reception. The resident undertakes not to take up residence at the establishment's address, either for tax or professional purposes, or to lend or sublet the apartment to a third party in any capacity whatsoever.

The resident must check the accuracy and quality of the inventory on arrival and report any discrepancies, missing or damaged items to reception within 24 hours of arrival. On the resident's departure, the inventory and state of cleanliness of the flat will be checked by SAS ARREAU BALCONS and the resident will be invoiced for any missing items or damage caused to the flat. SAS ARREAU BALCONS DES NESTES reserves the right to enter the rented premises for maintenance or security purposes.

Article 10 - Liability

SAS ARREAU BALCONS DES NESTES may not be held liable in the event of theft, loss or damage to personal belongings in the flats, communal areas, car parks and any other outbuildings or annexes of the residence, or for deposits left in the reception safe. As this accommodation contract is subject to the status of residences with services or tourist residences, the provisions of articles 1952 et seq. of the Civil Code, relating to hoteliers, do not apply.

Article 11 - After-sales service

Our reception team is at your disposal to respond to any complaints you may have, to resolve any malfunctions found and to help you make the most of your stay. Article 12 - General operating conditions

A document setting out the "general operating conditions" will be given to you on your arrival. Please note that only one pet per flat, weighing less than 45 kg, is permitted in the residence. Pets are not allowed near the swimming pool. They must be kept on a lead in the residence.

Article 13 - Changes to services

If circumstances oblige it to do so, and only in the event of force majeure beyond its control, SAS ARREAU BALCONS DES NESTES may be obliged to modify all or part of its services, both concerning accommodation and additional services such as breakfast. The services not provided will not be invoiced but no compensation may be claimed.

Article 14 - Termination - Penalties - Non-renewal

The contract will be terminated ipso jure, without formality and without delay, in the event of non-performance by the resident of one of his/her obligations or inappropriate behaviour likely to disturb the stay of the other occupants. The resident must leave the premises immediately and may be evicted if necessary with the assistance of the police. *

Article 15 - Jurisdiction of the courts

Only the Commercial Court of the Hautes Pyrénées department will have jurisdiction.
